Guilty Verdict in Shooting Death of Stockton (CA) Fire Captain

A jury on Tuesday convicted Robert Somerville of second degree murder in the shooting death of Stockton Fire Capt. Vidal “Max” Fortuna.

Fortuna, 47, was responding to a fire Aurora and Washington streets on Jan. 31, 2022 when Somerville shot and killed him.

Somerville, 68, had said the shooting was an accident, that he thought Fortuna was someone breaking into a home. CBS Sacramento reports.

Sentencing is set for April 10.
